Why: New York City advocated for a state law change to allow it to address the legalization of existing ADUs, including basement apartments, in the context of the state budget. While the measure was not included in the final budget, Assemblymember Epstein, Senator Kavanagh, their colleagues at the state and city level, and advocates are partnering with the City to advance legislation to safely legalize basement units before the end of the 2022 state legislative session.
