Advocates for people with disabilities have filed a federal lawsuit against the State Department of Health (DOH) and the Office for People with Developmental Disabilities (OPWDD) to challenge the State's allowing people to languish in hospitals, nursing homes, and immediate care facilities instead of supporting them in appropriate residences in the community.
Assemblymember Abinanti has long protested the State's failure to appropriately meet the needs of people with developmental disabilities. He has intervened on behalf of individuals stuck in hospitals and other inappropriate settings. He recently passed legislation for OPWDD to recognize Innovative Housing Alternatives (The legislation awaits Senate action).
